Elite Personnel is delighted to be recruiting on behalf of a well-regarded and growing law firm seeking an experienced and committed Solicitor in their Court of Protection department to join their specialist team.
This is an excellent opportunity to work within a highly specialised and rewarding area of law, representing vulnerable adults and their families in complex and sensitive matters. The successful candidate will join a supportive and collaborative team handling high-quality, meaningful work.
The Role
You will manage a varied caseload of Health & Welfare Court of Protection matters, including:
Applications and proceedings relating to capacity and best interests
Residence, care and contact disputes
Applications brought under legislation
Key Responsibilities
Managing a caseload of Health & Welfare Court of Protection matters
Drafting applications, statements and other court documentation
Instructing counsel where appropriate
Advocacy and attendance at Court of Protection hearings (where appropriate)
Advising clients, family members, professionals and deputies on capacity and best interests issues
Working closely with the Official Solicitor, local authorities, medical professionals and care providers
Ensuring compliance with the legislation and relevant case law
Supervising junior team members where appropriate
About You
Qualified Solicitor in England & Wales
Demonstrable experience in Court of Protection Health & Welfare work
Strong knowledge of the Mental Capacity Act 2005, Care Act 2014 and associated case law
Knowledge of Civil Legal Aid (desirable)
Excellent drafting, communication and advocacy skills
Compassionate, client-focused approach with the ability to manage sensitive matters
Strong attention to detail
Ability to work independently while contributing positively to a collaborative team
