Occupational Requirement for Language
Requiring Bengali fluency is a valid criterion because it’s essential to meet the core needs of our Bengali-speaking clients. It is a proportionate and necessary requirement directly related to job performance—ensuring effective communication, comfort, and safety.
Occupational Requirement for Gender
Under Schedule 9 of the Equality Act 2010, specifying female carers is lawful if:
The role genuinely requires a specific gender due to clients’ preferences (e.g., cultural norms around intimate care).
The requirement is a proportionate means to a legitimate aim, balancing clients’ privacy and dignity.
The Equality and Human Rights Commission confirms that roles such as carers can lawfully request a specific gender where intimacy and cultural expectations are involved. [personneltoday.com], [stoneking.co.uk]
Avoiding Discrimination
The advert avoids reference to nationality or ethnicity beyond Bengali language skill, which is legally distinct from nationality. We are targeting language ability, not race. The law requires us to advertise this as a “specific skill requirement”, not nationality. [keele.ac.uk], [equalityhu...rights.com]
Compliance with Advertising Guidelines
Per GOV.UK and ACAS, we can only specify gender or language if strictly necessary for the role and objectively justified. Our advert meets this by clearly stating the functional reasons for these requirements. [gov.uk], [acas.org.uk]
Full time or part-time days/ night shifts
If you are a female caregiver fluent in Bengali and passionate about delivering dignified, culturally aware care, we’d love to hear from you.
Apply now with your CV and a cover letter detailing your language skills and relevant care experience.
This advert is fully compliant with the Equality Act 2010’s occupational requirement exemptions, catering to both legal obligations and client needs.
