This opening assignment is for 3 months

Basic DBS disclosure required

Hybrid – in person attendance required at least fortnightly, this role will require frequent in person court attendance in addition.

Issue possession proceedings in respect of premises provided as temporary accommodation and premises occupied by unauthorised occupiers following termination of a secure tenancy.

Have conduct of defended and undefended matters and to represent the Council unsupervised before the Court, including on applications to suspend warrants or set aside orders. Provide legal advice, assistance and guidance to Officers in Landlord Services and Housing Demand (i.e. Income Services/Tenancy Management/Temporary Accommodation) on matters relating to the possession proceedings.

Key Responsibilities:

Preparation and conduct of cases from instruction to completion including drafting the claim form, particulars of claim and other relevant documents
Drafting all pleadings and other court documents necessary during the course of proceedings e.g. requests for and replies to requests for further information, lists of documents and disclosure. Once a judgement in proceedings is obtained, considering the facts and advising on the most appropriate method of enforcement
Conducting legal research
Producing management information reports using specialist reporting software where appropriate
Organising, analysing and interpreting statistical data using appropriate reporting tools
Manage casework to comply with time limits and meet deadlines to ensure that all matters are processed effectively and efficiently

Appearing unsupervised in the County Court before District Judges including on some routine contested cases and dealing with any points arising

Considering the evidence supplied by instructing officers and evaluate whether the evidence justifies the Council taking legal action. Checking the content of witness statements and obtaining further evidence as necessary to ensure a good case is presented. Ensuring that advocates and witnesses are fully appraised of the facts.

Knowledge:

Knowledge and understanding of law and procedure relating to housing litigation
Understanding of the issues involved in delivering services in a multi-racial and diverse community.
Understanding of the Council’s decision making processes

Experience:

Experience of possession proceedings
Advocacy experience

Skills & Abilities:

Effective keyboard skills, basic knowledge of word and excel and ideally a possession claims online system
Ability to communicate effectively both orally and in writing
Ability to conduct legal proceedings including preparation of claim forms, particulars of claim, advising on evidence, handling disclosure
Ability to represent the Council in court as an advocate
Effective time management and the ability to work under pressure and as part of a team
