This opening assignment is for 5-6 months

Versatile Lawyers with a “can do” approach to provide legal advice and support on all aspects of special educational needs, to include but not limited to decision making, policy and procedure.

The successful candidates will need to have good technical knowledge and experience in special educational needs and be able to manage a varied caseload of SEND Tribunal appeals, including advocacy in case management hearings and final hearings in the First Tier SEND Tribunal, with minimum supervision.

Applicants must be organised and able to work under pressure with minimal supervision while still being a valuable team player. Applicants must also have excellent communication skills enabling them to build strong relationships with clients.

Key Responsibilities

Provide routine and complex advice on legal issues and cases. Research and understand relevant areas of the law to ensure Council policies and procedures are compliant. Keep up to date with changes in legislation and ensure Council policies and procedures are adapted as appropriate.
Draft pleadings and witness statements. Prepare bundles for court/tribunal hearings. Where necessary, obtain legal advice on behalf of the Council. Instruct and / or brief Counsel to appear on behalf of the Council including attending conferences with Counsel and negotiating Counsel's fees.
Attend court/tribunal and present cases at interlocutory and final hearings on behalf of the Council.
Undertake negotiations on behalf on the council and contracted public bodies to resolve routine and complex matters. Liaise with Counsel, solicitors, expert witnesses and representatives of other parties.
Draft, negotiate and settle legal agreements and contracts on behalf of the Council.
This role requires the ability to fulfil all spoken aspects of the role with confidence and fluency in English.
Provide specialist assistance and support to Senior Lawyers and Managers in the Legal department on complicated cases.
Establish and maintain good working relationships both with clients and other members of staff. Instruct junior counsel and supervise junior members of the team.
Respond swiftly to any requests for information from Members, the public other Council departments and partner organisations.

Qualifications:

Law Society admitted and Solicitor Regulatory Authority registered solicitor, Fellow of the Chartered Institute of Legal Executives or Bar Standards Board registered barrister.

Knowledge:

A thorough knowledge of that area of law

Experience:

Considerable experience in case management
Demonstrable experience of working in a particular field.
Adequate experience of managing own workload.

Skills & Abilities:

Good advocacy skills
Excellent communication and presentational skills both verbal and written including influencing and persuasion.
Excellent ICT skills and a degree of administrative self-sufficiency although some secretarial support will be provided.
Ability to work under pressure and to tight deadlines.
Ability to travel.
Ability to absorb and interpret legislation, case law and procedures.
Ability to assimilate facts and present these in a coherent fashion in order to facilitate desired result for the council. It is important to note the impact of incorrect advice and poor advocacy could be financially very significant.
Ability to assimilate detailed and complex information and make judgments on the way that certain procedures have been followed.
