37 Monday to Friday, normal working hours

This opening assignment is for 5-6 months

Hybrid working - negotiable around office attendance, but candidate will have to be a little flexible if needed.

Operating primarily in the field of education law, from time to time you may also be expected to offer support and advice to councillors and officers in the area of adult social care work. The post involves advocacy in the Special Educational Needs Tribunal and other tribunals. Undertake the provision of legal advice, guidance and support on behalf of the Borough Council (and its schools) in relation to and Education matters with some Adult Social Care work some of which may be complex.

Key Responsibilities:

Conduct advocacy at all levels with respect to the above matters before the Special Educational Needs and Disability Tribunal, Appeal Panels, the Court of Protection and any other appropriate tribunal.
Proactively advise and respond to all requests for legal advice. Advising on the proposed impact of any legislation as and when appropriate to the Client Departments taking into account novel applications of known techniques
Undertake all preparations in relation to Advocacy including preparation of bundles, skeleton arguments and statements ensuring full compliance with legislation and guidance, attendance at advocates meetings and to liaise with Counsel as and when required.
Attend relevant meetings including where applicable Safeguarding Board meetings, Joint Partnership Groups, and Legal Gateway meetings.

Qualifications:

Qualified solicitor or barrister or chartered legal executive or equivalent legal experience with a background in local government.

Knowledge:

Good knowledge of relevant legislation to the service area and the decision-making processes and procedures.
Good understanding of current issues and best practice on service delivery relevant to the service areas.

Experience:

Local Authority experience is required for this role.
Experience in education law including conduct of SEN Tribunals and advising on issues such as governance, admissions, exclusions and school transport.

Skills & Abilities:

Good and demonstrable analytical legal skills.
Excellent communication skills
Team skills and the ability to interpret legislation in a common sense and practical manner
Ability to work under pressure and respond efficiently to the changing needs of the clients.
Ability to be able to travel to attend client officers or courts wherever the client’s case is being considered.
Ability to contribute to the ongoing development of the Shared Legal Service.
Ability to be available to attend premises out of hours to attend evening meetings and in the event of emergencies or urgent management issues in relation to all 5 authorities.
