Summary


An opportunity has arisen for a highly motivated, competent and dependable Claims and Inquest Manager to join our busy Legal Services Department at Chelsea and Westminster Hospital NHS Foundation Trust.

We are looking for an individual who works to high personal and professional standards, paying attention to detail. Ideally you will be someone who responds well to a fast-paced environment and who can readily adapt to changing work priorities with the ability to multi-task, whilst at the same time remaining calm and professional.

The successful candidate will be responsible for their own caseload including clinical negligence claims, employer and public liability claims, Coronial matters and Police and Local Authorities' requests, performing a variety of investigative and reporting duties.

The Claims and Inquest Manager is to work within the Legal Services Department and to be responsible for the day-to-day management and monitoring of claims against the Trust.

In addition, the post holder is to manage Coronial matters that are allocated by the Head of Legal servcies; by liaising with the coroner's officers, other Interested Persons, solicitors if appointed and the Trust clinicians. The Claims and Inquest Manager is responsible for complying with disclosure and obtaining witness statements from the relevant clinicians.

1. Claim

The post-holder will:

1.1 Maintain an expertise in Claims and Inquest Management and manage all claims against the with the Head of Legal Services, Legal Services Manager, Trust Paralegal and NHS Resolution and panel firms as necessary.

1.2 Manage and prioritise own workload and work as part of a team within the Legal Services Department.

1.3 To be responsible for disclosure of medical records and any other documents as requested by -clinical claims or pre- action matters in accordance with the relevant Pre-Action Protocols, Data Protection Act 2018 and Access to Health Records Act 1990.

1.4 Manage the pre-action disclosure of relevant staff records when a request for disclosure ofrecords is received in relation to an employers or public liability claim. Ensure that legal timescales for disclosure are met.

1.5Assess and investigate all new claims by considering complex facts to identify whether anybreach of duty of care occur and assess the potential quantum

2. Coronial matters

2.1To undertake day-to-day management of allocated Coronial matters, including obtaining witness statements and any other documents (including medical records) and ensuring their accuracy prior to disclosure of the same to the Coroner and or any other Interested Person if required by the Coroner.

2.2 Establishing and maintaining close liaison with the coroner's officersand considering whether or not legal representation may become necessary including applying to NHS Resolution for funding when directed.

2.3Establishing and maintaining a point of contact and support for all staff called to give evidence at Inquest.

2.4Ensuring that pre-inquest meetings are conducted with staff called to give evidence at an inquest
