Summary


Working in conjunction with our panel of solicitors the post holder will be responsible for :

· Manage a portfolio of claims and inquests cases

· Lead on case management and be responsible for routine reporting on clinical negligence, and inquest activity, and for highlighting any potentially problematic cases and those likely to become high risk.

· To line manage and supervise the Patient Safety and Litigation Assistant including supporting them on specific cases.

· Wide-ranging collaboration with both internal and external colleagues. The role requires attention to details and analysis and interpretation of complex information, both quantitative and qualitative and contribution to devising strategies and approaches to resolve issues.



The post holder must be able to exercise significant discretion to work within assigned parameters and must have the confidence and the abilities to be able to identify and escalate any potential matters of concern relating to the Trust, which may cause reputational damage or adverse publicity.

Identify across all staff groups colleagues who are likely to have information and knowledge which would be material and useful to the Trust in the conduct of the inquest or the claim.

Provide advice and support to colleagues on inquests and claim related matters

Inquests

· Obtain all relevant information including procedures and protocols, witness statements, expert opinions

· Ensure potentially contentious inquests are managed effectively to reduce risks to the Trust.

· Establish close liaison with Coroners’ Officers about Inquests and requirements for the Trust to be legally represented

· Collaborate with the Trusts solicitors in relation to inquest preparation

· Ensure that all staff have a point of contact to support them including the preparation of statements, offering advice if needed.

· Ensure that the Trusts Communications Department are provided with a summary of the case

· Attend HMC Court to represent the Trust at Pre-inquest hearings and on occasions during the final Inquest.

Clinical Claims Management

· Investigate applications for the disclosure of records where it is indicated that a claim against the Trust is being considered.

· Investigate and handle claims relating to clinical negligence in accordance with the Trust’s Claims Management Policy.
• Direct the work of the Patient Safety and Litigation Assistant supporting the post holder ensuring that the Datix system and paper files are maintained
• Act as the Trust’s named point of contact with NHS Resolution, Trust solicitors and claimant’s solicitors.
• Ensure that confirmed clinical negligence claims are reported to National Health Service Resolution (formerly NHSLA)

This exciting opportunity is being offered as a substantial position. Thesuccessful post holder will be working with our panel of solicitors to support both the inquest and claims process. The post holder will be supported by the Patient Safety and Complaints Manager and Patient Safety Specialist.Working in conjunction with our panel of solicitors the post holder will be responsible for :

Managing a portfolio of inquests in line with current guidelines/policies and procedures and liaising with HM Coroners officers from the point of request to inquest conclusion. Responsible for managing a portfolio of claims inquests in line with current guidelines/policies and procedures and liaising with Claimant’s solicitors, NHS Resolution and Trust solicitors. T

Provide the Risk Systems Manager with a monthly ‘Reportable Issues Log’ that can be shared with members of the Trusts Quality Delivery Group.
