Hertfordshire and West Essex ICS is in the process transferring the pathology services currently run by 3 partner NHS hospital trusts and the wider local care system to a private sector provider. This work is part of a national programme mandated by NHS Improvement.

A preferred contractor has been appointed and we are now embarking on a 9 months’ ‘service mobilisation’ phase – at the end of which, ourpathology staff will be transferred (under TUPE regulations) to the new provider’s employment.

A temporary HR professional is now being sought to join the Workforce Workstream, with responsibility for co-ordinating TUPE transfer related work with senior HR leads across the partnership and ensuring that all aspects of the TUPE process run smoothly.

Applicantsmusthave experience of having worked in a ‘hands on’ HR advisory capacity on all aspects of at least one fully completed public sector TUPE transfer process involving employees based on more than one site and be capable of working effectively across a multiple employer partnership.

Flexible working applications will be considered, but the postholder mustbe prepared to fully support the TUPE employee consultation process, including working physically on-site and travelling between the sites of partner trusts as required.

The postholder willreport to the partnership’s Pathology Workforce Workstream Lead, Roger Nielsen.

The primary purpose of this post is to support the multi-partner TUPE transfer of Pathology Services from 3 x NHS organisations to a private sector provider at the end of the agreed ‘service mobilisation’ phase of the overall project. Specific responsibilities include ensuring:
• Consistency in the staff transfer processes adopted – and the TUPE advice given to service managers – within / across each partner organisation, in particular in respect of the ‘employee information and consultation’ stage.
• That trades union colleagues feel that they have been meaningfully engaged in the ‘employee information and consultation’ stage of the TUPE process.
• All transfer related queries / concerns raised by directly affected / transferring employees have been demonstrably addressed prior to the date of staff transfer
• If subsequently challenged about the robustness of any element of the TUPE process, HWEICS will be able to evidence that it has run a highly professional, fully legally compliant and competently managed staff transfer process.
